Transparency declaration according article 13 GDPR

This Privacy Policy explains how your personal data is used by SWISS KRONO and what rights and options you have in this regard.

It applies to all personal data that you provide to SWISS KRONO or that is obtained from such data.

Information on how we use the data collected by cookies or other web tracking or analysis technologies is explained in our Cookie Policy.

Who is responsible for your personal data

We, SWISS KRONO TEX GmbH & Co. KG, are responsible for all personal data that you make available to us within the scope of our business relationship.

Categories of personal data collected by us

In particular, we collect and process personal data that falls into the following categories:

  • Contact information such as your full name, business address, business phone number, business mobile phone number, business fax number and business email address, the unique identifier of your mobile device and the IP address of your computer when you use our websites;
  • Payment information, e.g. information required to process payments and prevent fraud, including credit/debit card numbers, security codes and other billing information;
  • Other business information that is necessarily processed or is voluntarily provided by you in a business or other contractual relationship with SWISS KRONO, such as orders placed, purchases made, services provided and other business transactions, feedback on products and other information you provide to us;
  • Information obtained from public sources, secure databases and credit bureaus; and
  • When it is legally required for compliance purposes: Information about significant and substantial litigation or other legal proceedings involving you or a related party and interaction with you that may be relevant for antitrust purposes.
  • Special categories of personal information: In connection with registering for and granting access to an event or seminar, we may request information about your health in order to determine and address any disability or special dietary needs you may have. Any such information will only be used with your consent. If you do not provide us with information about disabilities or special dietary needs, we will not be able to take any appropriate precautions.

For what purposes we use your personal data

We will use your personal data exclusively for the following purposes ("Permitted Purposes"):

  • to plan, execute, control and manage your contractual relationship (or the contractual relationship of a third party with whom you are related) with the SWISS KRONO Group, e.g. by executing transactions and orders for products or services, processing of payments, performing accounting, auditing, billing and debt collection activities, initiating shipments and deliveries, enabling repairs and providing support services, or providing you with other services or items that you may have requested;
  • maintaining and protecting the security of our products, services and websites or other systems that prevent and detect security risks, fraud or other criminal or malicious acts;
  • ensuring compliance with legal obligations (such as bookkeeping obligations), compliance audits or record-keeping obligations (e.g. as part of competition laws, export laws, trade sanctions and embargo laws, or the prevention of white-collar crime or money laundering); this may include comparing your contact information or other information you provide about your identity with applicable lists of sanctioned parties and contacting you to confirm your identity if a possible match is found during such comparison, or recording any interaction with you that may be relevant for antitrust purposes;
  • contacting you within an existing business relationship to the extent permitted by local law in order to inform you about SWISS KRONO products or services that are similar to or related to those you have already purchased or used in the course of that business relationship;
  • the settlement of disputes, the enforcement of our contractual agreements and the establishment, exercise or defense of legal claims or
  • ensuring compliance with legal obligations, e.g. retention of sales documents for tax purposes or sending legally required notices and other announcements.

If you have given us your express consent, we may also use your personal data for the following purposes:

  • communicating with you through the channels you have approved to keep you updated about the latest announcements, special offers and other information about SWISS KRONO products, technologies and services (including marketing related newsletters) as well as events and projects of SWISS KRONO;
  • the management and implementation of customer surveys, marketing campaigns, market analyzes, competitions or other promotional measures or events or
  • collecting information about your preferences to create a user profile in order to make our communication and interaction with you more personal and to improve the quality (for example, through newsletter tracking or website analyzes).

With respect to marketing-related communication methods (e.g. e-mails and telephone calls), we will only provide this information to you, as far as required by law, if you have previously consented to such disclosure, and we will give you the opportunity to withdraw your consent if you do not wish to receive further marketing-related communication from us.

We will not use your personal information to make automated decisions that affect you or create profiles other than those described above.

The legal basis for processing your personal data is laid down in Article 6 of the General Data Protection Regulation.

Depending on which of the above-mentioned purposes we use your personal data for, the processing is necessary either to fulfill a contract or another business agreement with SWISS KRONO or to comply with our legal obligations or to pursue our legitimate interests; always provided that your interests or fundamental rights and freedoms do not take precedence over these interests.

Furthermore, the processing can also take place on the basis of your consent, if you have expressly granted it to us.

How we collect and use your personal data

We will normally collect your personal information directly from you as part of our interactions with each other, such as when you visit our website, communicate with us regarding our products and services, place an order, register for our newsletter or participate in our customer surveys.

We do not receive personal data from third parties, unless it is absolutely necessary for the execution of the contractual relationship with us (e.g. forest management associations / forest owner associations).

Where personal data is processed

SWISS KRONO is a globally active company. In the course of our business operations, we may also transfer your personal data to recipients in countries outside the European Economic Area ("third countries") where data is not protected by law to the same extent as under the laws of your home country.

If we do so, we will comply with applicable data protection requirements and take reasonable security measures to ensure that your personal data is protected and secure, in particular by agreeing to EU standard contractual clauses, which are available here.

How we protect your personal data

To protect your personal data, we take physical, electronic and procedural security measures in accordance with the recognized state of the art and the legal data protection requirements.

These security measures include the implementation of certain technologies and procedures such as secure servers, firewalls and SSL encryption, which are aimed at protecting your privacy. We will at all times strictly comply with applicable laws and regulations regarding the confidentiality and security of personal data.

With whom we share personal data

We may share your personal information as follows:

  • With our affiliated companies within the SWISS KRONO Group worldwide, if and to the extent that this is necessary for the Permitted Purposes and is legally permissible. In such cases, the companies will use the personal data for the same purposes and under the same conditions as set forth in this Privacy Policy.   • Furthermore, it is possible that we may, on our behalf and exclusively upon our instructions, commission service providers (so-called contract data processors), which are part of the SWISS KRONO Group or are external providers located in Germany or abroad, to process personal data for the Permitted Purposes. SWISS KRONO shall retain control of your personal data and remain fully responsible for it and shall take the appropriate security measures required by applicable law to protect your personal data if such service providers are commissioned.
  • With courts of law, law enforcement agencies, regulatory authorities or attorneys, to the extent permitted by law and necessary to satisfy a legal obligation or to establish, exercise or defend claims,
  • With credit bureaus and other companies as part of credit decisions to prevent fraud and for debt collection.

In all other cases, we will only disclose your personal information if you request or authorize us to do so, if we are required to do so by applicable law or regulation or by court or official order, or if we suspect fraudulent or criminal activities.

Retention period of personal data

We will retain your personal data for as long as necessary to provide the services, products or information you have requested and to manage your business relationship with us.

If you have asked us not to contact you, we will retain this information until your request has been fulfilled.

In addition, we are required by applicable law to retain certain personal information about you for a limited period of time (e.g. in connection with business transactions).

Your personal data will be deleted immediately if it is no longer required for these purposes.

Your rights

Subject to certain legal conditions, you may request access to your personal data or its correction or deletion or limitation of its processing.

You may also object to processing or request the transfer of data.

In particular, you are entitled to request a copy of the personal data we have stored about you. If you express this wish more than once, we may charge a reasonable fee for this.

Details of your data protection rights can be found in Articles 15-22 of the General Data Protection Regulation. Because we want to ensure that your personal data is accurate and up-to-date, you can also ask us to correct or remove any information that you believe to be incorrect.

If you have consented to the processing of your personal data, you can revoke your consent at any time with effect for the future, i.e. the revocation of consent has no influence on the legality of the processing that was carried out on the basis of the consent prior to this revocation.

Should the consent be revoked, we may only further process the personal data if there is another legal reason for doing so.

If you wish to assert any of the above rights, please send us a description of your personal data concerned, stating your name, your customer number (or other SWISS KRONO identification number) and your date of birth as proof of identity, to the contact details given below.

We may require additional proof of identity (a certified copy of your passport or ID card) in order to protect your personal information from unauthorized access.

We will carefully consider your request and may discuss with you how best to fulfill it.

If you have any concerns about how we handle your personal information, or if you wish to complain about our handling of your personal information, please contact us using the contact information mentioned below for an investigation of the matter.

If you are not satisfied with our response or reply, or if you believe that we are not processing your personal information in accordance with applicable law, you may file a complaint with the regulatory authority responsible for data protection in your country.

Obligation to provide personal data

In principle, you provide us with your personal data voluntarily. In general, there are no negative consequences for you if you do not consent to or do not provide personal data.

However, there are cases in which SWISS KRONO cannot act without your specific personal data, e.g. if this personal data is required to process your orders, to provide you with access to an online offer or newsletter or to carry out a legally required compliance check.

In these cases, SWISS KRONO unfortunately cannot fulfill your request/wish without the relevant personal data.

Changes to this policy

This Privacy Policy was last amended in May 2018.

We may amend or supplement this policy from time to time in order to reflect changes in the way use your personal information or to comply with changes in legal requirements.

It is therefore recommended that you review this statement from time to time.
Changes to the privacy policy are effective from the date they are posted on our website.
